Of subtle importance attached to this issue is Resolution 60/7 establishing 27 January as an International Holocaust Remembrance Day and urges every member nation of the U.N. to honor the memory of Holocaust victims, and encourages the development of educational programs about Holocaust history to help prevent future acts of genocide as it also rejects any denial of the Holocaust as a historical event. It singularly encourages mobilization of civil society for Holocaust remembrance and education. Affirming we must also go beyond remembrance, and make sure that new generations know this history.

In more fully accessing the overt and subtle ramifications of this resolution we must also consider the remarks of Norman G. Finkelstein of the City University of New York who states: ' "The Holocaust" is an ideological representation of the Nazi holocaust. Like most ideologies, it bears a connection, if tenuous, with reality. The Holocaust is not an arbitrary, but rather an internally coherent construct. Its central dogmas sustain significant political and class interests. Indeed, The Holocaust has proven to be an indispensable ideological weapon.

Through its deployment, one of the world's most formidable military powers, with a horrendous human rights record, has cast itself as a 'victim' state, and the most successful ethnic group in the United States has likewise acquired victim status. Considerable benefits accrue to this specious victimhood – in particular, immunity to criticism, however justified. " (Finkelstein, The Holocaust Industry: Reflections on the Exploitation of Jewish Suffering, New Edition 2nd Edition (2000) published by Verso, p 3). Finally, I do assert we cannot forget that this resolution has the force of international law.

General Assembly resolutions can be looked upon to be non-binding recommendations but it might be argued that this non-binding character does not mean that advisory opinions are without legal effect, because the legal reasoning embodied in them reflects the International Criminal Court's authoritative views on important issues of international law and, in arriving at them, the Court follows essentially the same rules and procedures that govern its binding judgments delivered in contentious cases submitted to it by sovereign states. In this view, an advisory opinion derives its status and authority from the fact that it is the official pronouncement of the principal judicial organ of the United Nations when we consider there is the signed "Negotiated Relationship Agreement between the International Criminal Court and the United Nations."

Furthermore, UN Model Treaty on the Transfer of Proceedings in Criminal Matters; the UN Model Treaty on Extradition; and the UN Model Treaty on the Transfer of Proceedings in Criminal Matters; all spring from UN Resolutions as did Resolution 60/7 establishing 27 January as an International Holocaust Remembrance Day. Arguments potentially being raised concerning the applicable jurisprudence reaching into those items composing the language and content of these legally controlling documents and whether these written elements are grounded in legal fiction, hearsay or substantive evidence.

Goldstone's espousing the applicability of 'truth finding, I believe should be equally applied in testing the elements contained within the UN Resolution Denial of the Holocaust as a legal document; with no lesser scrutiny than the investigation of the allegations levied in the Goldstone Report. International Criminal Court Rules of Procedure and Evidence under Rules 66 and 67 asserts that truth telling is a solemn duty and the venue employed must be conducive to the giving of truthful and open testimony. To wit: (1) What does "never happen again entail?" (2) How does the unintended consequence and employment of the Holocaust Commemoratives impact the UN Charter in its quest for global peace? (3) Does the official 'histography' of the Holocaust withstand inspection and rigor as a legal theory delineated in Resolution 60/7? Truth telling escalates when the resolution directs us to teach Holocaust history throughout the generations of our children's children.

Legal challenges of Israel before the courts could be the great Armageddon of our day and it needs be recognized clearly that the Goldstone report provides the doorway. Wherein, legal footing can be grounded, if carried to its logical conclusion, allowing the Palestinians to question the legality of the unilateral declaration of Israel to statehood without endorsement of the Nation of Palestine. Such threat might be sensed by those of us on the outside of the issue but I am persuaded Israel fully realizes this legal fact of life. As we look upon them and consider their constant arm twisting and screaming demands to be recognized as "having a right to exist". In a court of law someone might possibly allow raising questions of their perceived right of sovereignty and jurisdictional latitudes.

Questions and inquiry thereafter being raised asking who are the legal and necessary persons who may or may not participate or be prosecuted in the proceedings before the International Criminal Court Tribunal. Should the Nation of Palestine be recognized in this forum and Israel relegated to some other judicial status in the proper address of war crimes allegations? I pray that some legal professional will come to the forefront to properly address these inasmuch as I am not a lawyer and I dare not lift my head up out of the foxhole to give a legal opinion.

But, didn't Israel violate the terms and contractual covenants they agreed to in order to satisfy membership requirements for their legal entry into the United Nations? And perhaps that condition was imposed as necessary in exchange for Israel to be legitimately recognized as a nation; after Israel having failed in their first application submittal? Upon resolution of these, motif behind the slaughters in the Gaza Holocaust might even be legally redefined to just plain old murder.

For the Palestinian side, Prior to its admission to United Nations membership, Israel made clear pledges to the members of the United Nations that it would implement resolution 181 (II) and resolution 194 (III) of 1949, related inter alia to the rights of Palestine refugees. In actuality, resolution 273 (III) of 11 May 1949, admitting Israel to membership in the United Nations, recalled in its preamble both of those resolutions and took note of the declarations and explanations made by the representative of the Government of Israel before the Ad Hoc Political Committee with respect to the implementation of the said resolutions [Jerusalem in International Diplomacy http://www.jcpa.org/art/jid-apx.htm].

There seems to be no noticeable will to do what is necessary to stop the blood letting. "Anyone who rejects the two-state solution, won't bring a one-state solution. Yet, on the Arab side we hear, "Every situation has unique features, and although there are patterns in history, it never repeats itself exactly. 'Political will to comment horror was in effect its own brand of genius during the time of war,' paraphrasing Marlon Brando in his 1979 'Apocalypse Now' role as Green Beret Colonel, Walter Kurtz, whose army has crossed the border into Cambodia and is conducting hit-and-run missions against the Viet Cong and North Vietnamese Army (NVA). While the exceptionally high level of political consciousness of the Jewish Yishuv united around acquiring the entirety of Palestine as their single national purpose by the end of 1947. The Zionist social institutions and infrastructure were converted into a shadow government that intermingled with powerful world leaders and garnered global financing from the Jewish Diaspora. Next area of global confrontation for the Nation of Palestine will be the International Criminal Court, which even now is being politically mapped by the United States. Subsequently, the torrent waged against the credibility and truthfulness of the Goldstone report was meticulously carried out as witnessed by the article 'Leyden Communications Helps Israel On UN Goldstone Report'. It seems that the lessons and power of the media employed by Hitler against the Jews has been an education well learned and embraced in this century by the "Chickens who have come home to roost!" Although this provides a formidable challenge for those who are desirous of a level playing field, equity and some utopian sense of fairness, we must understand that this is about domination and power. So, the Arab nations must somehow find the necessary stuff to cooperatively pool their resources to combat this in the UN General Assembly, the cyber-space of our collective minds and in the complex of courts made available to sovereign nations, NGO's and monies available by the Gulf Cooperation Council financial war coffers.

Palestinian resistance must surely see they cannot overcome Israel through direct confrontational stages of traditional war. President Bush has declared that this is a global war on terror and borrowing from the infamous line of Michael Corleone in Godfather II, "If history has shown us anything, it shows us that you can kill anybody." I am reminded of the question raised during the 1960's civil rights era in the United States, "..who should we follow, Martin Luther King or Malcolm X." Forthcoming was a response along the lines, "There are many roads to freedom and they all must be traveled." I now conclude the Palestinians do not need more martyrs, rather what is required is wise and cunning leadership with intestinal fortitude coupled with vision.

Ideology of Sun Tzu finds expression in the Palestinian resistance when we first realize "The art of war is of vital importance to the State. It is a matter of life and death, a road either to safety or to ruin.  Hence it is a subject of inquiry which can on no account be neglected." What lies at issue are the public relations deceptions perpetuated by the Zionist media that, "Lest we forget" they are going to shove 60 more years of their nobility under duress message across the airwaves. Neither the Palestinian peoples nor their supporters to my knowledge have published the picture of what a free sovereign Palestine would look like. Why do we not follow the lead of Iranian President Mahmoud Ahmadinejad when he spoke before the United Nations about governance that reflects the highest aims of Islam, "... men should pursue to be governed by the spiritual laws set forth within the context of the highest aims in the lives of men to be: "Peoples, driven by their divine nature, intrinsically seek good, virtue, perfection, and beauty. Relying on our peoples, we can take giant steps towards reform and pave the road for human perfection." Let this be the Nation of Palestine's' message to the world lest we forget all war is deception."

Perhaps the most profound tribute to General Sun Tzu's work entitled the Art of War is written 1400 years later in the 1988 Vietnam Magazine's interview with Colonel Harry G. Summers. Colonel Summers shared the following exchange, "But America's fighting forces did not fail us. You know, you never beat us on the battlefield," I told my North Vietnamese counterpart during negotiations in Hanoi a week before the fall of Saigon. He pondered that remark a moment and then replied, "That may be so, but it is also irrelevant." Sun Tzu says: ‘The consummate leader cultivates the moral law, and strictly adheres to method and discipline; thus it is in his power to control success.'

Israel's employment of Sun Tzu is most clearly seen in the stratagem of causing the nations of the world to chase the tail of some peace initiative dog when Israel's real design springs from the 16th Century Niccolo Machiavelli model of class privilege, deceit and manipulations of the powerful. Similarly, the Zionist agenda concentrates its focus upon the establishment of a superior and privileged society. Response of the great general Tzu was to employ as few persons as possible to acquire as much space as possible. A maxim practically asserted by Samuel Adams emphasizing, "It does not take a majority to prevail ... but rather an irate, tireless minority, keen on setting brushfires of freedom in the minds of men."

World War II Normandy Invasion was not won by a great cloud of military might but rather two or three buddies fighting relentlessly side by side and staying under the radar. What unites and binds under moral law is opposition to barbarism, murder, rape and exploitation of the natural resources of the Middle East and underdeveloped nations. Alliances could be investigated and sought out with the types of organizations supporting the Goldstone Amendment (i.e. NGOs Initiative to Endorse and Implement The UN-Fact Finding Mission Report on the Gaza Conflict).

In addition grassroots organizations could seek and attempt to work with the ACLU, pre-law and legal professionals in formulating criteria for actions. These can all mass together to challenge the Pro-Zionist ideologies and their henchmen, business and political cronies via impassioned legal research and preparation of the necessary legal documents while at the same time, living this story out before our children, friends and neighbors. Sincere efforts of a few high school students can become the bedrock employed to challenge the imperialistic status quo. Efforts of students to partner in all manner of research can lend momentum even through the very legal systems of the pro-Israeli lobby supporters. Or, we can simply take our own quiet initiatives within the information age of public opinion.

Energizing access to both the affluent and humble contributor of funds is the strength of the Israeli model and it behooves being studied, employed and dismantled utilizing strategic grassroots operations. Sun Tzu's adage, "With his forces intact he will dispute the mastery of the Empire, and thus, without losing a man, his triumph will be complete. This is the method of attacking by stratagem."
