By Stephen Lendman* | Sabbah Report | www.sabbah.biz

On May 31, 2010, Israeli commandos willfully and maliciously interdicted Freedom Flotilla vessels in international waters, bringing humanitarian aid to besieged Gazans.

In the process, they slaughtered nine Turkish nationals aboard the mother Mavi Marmara ship, wounding dozens more, and arresting everyone on board.

A same day article described what happened as known at the time.

It was a well planned premeditated attack against unarmed, nonviolent humanitarian activists, trying to break Israel's illegal blockade to deliver essential aid. Cold-blooded murder resulted.

Note:

Under international and US law, blockades are acts of war, variously defined as:

surrounding a nation or objective with hostile forces;

measures to isolate an enemy;

encirclement and besieging;

preventing the passage in or out of supplies, military forces, or aid in time of or as an act of war; and

an act of naval warfare to block access to an enemy's coastline and deny entry to all vessels and aircraft.

Law Professor Francis Boyle calls blockades:

"belligerent measures taken by a nation (to) prevent passage of vessels or aircraft to and from another country. Customary international law recognizes blockades as an act of war because of the belligerent use of force even against third party nations in enforcing the blockade. Blockades as acts of war have been recognized as such in the Declaration of Paris of 1856 and the Declaration of London of 1909 that delineate the international rules of warfare."

America approved these Declarations, so they're binding US law as well "as part of general international law and customary international law." Past US presidents, including Dwight Eisenhower and Jack Kennedy, called blockades acts of war. So has the US Supreme Court.

Occupied Palestine poses no threat to Israel. In the past, Israel admitted it. As a result, imposing a blockade violates the UN Charter and other international and US laws. It's also an illegal act of aggression that under the Nuremberg Charter constitutes the "supreme international crime against peace."

Last September, the UN Human Rights Council (HRC), issued damning findings, "conclud(ing) that a series of violations of international law, including international humanitarian and human rights law, were committed by the Israeli forces during the interception of the flotilla and during the detention of passengers in Israel prior to deportation."

By imposing an illegal blockade, Israel willfully and maliciously caused a grave humanitarian crisis, affecting nearly 1.7 million Gazans, mostly civilians. Aid is vitally needed. Blocking it is a crime against humanity. Moreover, Israel's international waters interdiction was piracy.

A "vessel on the high seas (posing no threat) is subject to the exclusive jurisdiction of its flag State."

Under the laws of armed conflict, a blockade is also illegal if:

(a) its sole purpose is starving the civilian population or denying it other essentials for life; or

(b) the damage to civilians is, or may be expected to be, excessive in relation to the concrete or direct military advantage anticipated.

In other words, no blockade is permitted it it disproportionately harms civilians. Israel has done it maliciously for over four years, collectively punishing Gazans illegally, despite admitting no security threat exists.

HRC said Israel's interdiction was lawless "since there was no legal basis for the Israeli forces to conduct an assault and interception in international waters."

Moreover, in doing so, Israel was "obligated" to respect international law and its own "international human rights obligations."

HRC thus concluded that force used "was unnecessary, disproportionate, excessive, inappropriate and resulted in the wholly avoidable killing and maiming of a large number of civilian passengers."

In addition, Israel made "a deliberate attempt....to suppress or destroy evidence," besides fabricating its own version of events, including fake videos and other falsified materials.

Despite indisputable crimes against humanity and piracy, UN Secretary-General Ban Ki-moon shamelessly named his own, largely pro-Israeli commission, mocking justice and his own credibility in the process.

Former New Zealand Prime Minister Geoffrey Palmer chaired it along with former Colombian President Alvaro Uribe as vice-chairman. His appalling record in office and contempt for human rights should have automatically disqualified him.

Notably, he was tainted by corruption and scandal, with close links to his country's drug cartels and paramilitary death squads. As a result, he bore direct responsibility for murdering thousands of trade unionists, campesinos, human rights workers, journalists, and others opposing Colombia's narco-state terrorism and ties to US imperialism.

Nonetheless, he was shamelessly appointed to decide whether or not Israeli commandos committed high crimes because as Colombia's president, and now, he staunchly supports the worst of US and Israeli crimes.

He, Palmer and Joseph Siechanover, former head of Israel's Defense Mission to the US and Canada, proved their loyalty in contrast to the commission's fourth member, former Turkish official Ozdem Sanberk, who likely wanted conclusions other than those reached.

They were mixed, largely absolving Israel of cold-blooded murder and condemning its illegal siege.

The full report can be accessed through the following link:

http://graphics8.nytimes.com/packages/pdf/world/Palmer-Committee-Final-report.pdf

The New York Times obtained it a day ahead of its expected September 2 release. Writers Neil MacFarquhar and Ethan Bronner headlined, "Report Finds Naval Blockade by Israel Legal but Faults Raid," saying:

The UN report "found that when Israeli commandos boarded the main (Mavi Marmara) ship they faced 'organized and violent resistance from a group of passengers' and were therefore required to use force for their own protection."

However, it determined that its use was "excessive and unreasonable," calling deaths and injuries caused as well as Israel's treatment of passengers abusive.

Haaretz writer Barak Ravid also covered the story, saying:

"The report harshly criticizes the flotilla organizers, stating 'they acted recklessly in attempting to breach the naval blockade,' " adding that "there exist serious questions about the conduct, true nature and objectives of the flotilla organizers, particularly IHH (a Turkish charity)."

Also emphasized was that Turkey could have done more to persuade its nationals not to participate. Nonetheless:

"Forensic evidence showing that most of the deceased were shot multiple times, including in the back, or at close range has not been adequately accounted for in the material presented by Israel."

The report was ready for publication months ago, but was delayed to give Turkey more time to press Israel for an apology not forthcoming. In fact, Israel never says it's sorry, even when caught red-handed.

Fact check

As explained in part above:

(1) Gaza's siege is illegal. Saying otherwise doesn't wash. Neither Hamas, other Palestinian resistance groups, or the PA threaten Israel, except in self-defense retaliation against premeditated Israeli attacks as international law allows.

(2) All Flotilla participants were unarmed, nonviolent human rights activists. Nonetheless, they were maliciously attacked in international waters. Moreover, Israeli commandos had photos of Turkish nationals marked for assassination. They identified and shot them in cold blood multiple times at point blank range.

(3) The UN Human Rights Commission (HRC) examined the same evidence, holding Israel culpable for high crimes.

Turkey's Response to the Palmer Commission Report

On September 1,Turkish Foreign Minister Ahmet Davutoglu said the Palmer Report's release constituted Israel's last chance for a formal apology. Without it, he warned of possible sanctions and other consequences.

Israel never apologized. Moreover, Netanyahu told US officials that decision's unchanged. As a result, Turkey may scale back its diplomatic representation, including expelling Israel's ambassador (Gabby Levy) and his deputy (Ella Afek).

Turkey also is expected to initiate a diplomatic and legal campaign against Israel through the UN, and will help loved ones of those killed sue Israel in world courts.

In addition, legal action may be taken against responsible Israeli officials, including Netanyahu, Defense Minister Ehud Barak, then Israeli Defense Forces Chief of Staff Gabi Ashkenazi, and Navy Commander Adm. Eliezer Marom.

Moreover, billions of dollars of trade between the two country are at risk.

Turkey also was angry that the commission mostly adopted Israeli friendly conclusions. At the same time, Israel was pleased.

Final Comments

Absolution is unacceptable. Nonetheless, Israel again got largely off the hook, free to commit more crimes of war and against humanity, besides ongoing daily ones in Gaza, the West Bank and East Jerusalem.

At issue is stopping them, ending Gaza's siege, Israel's occupation, and granting Palestine statehood and full UN membership later this month when the UN General Assembly meets.

Even then, Israeli lawlessness won't end. Perhaps it'll only be slowed, but any committed will be against a sovereign state able to sue through the World Court for redress, and be able to get a temporary restraining order to stop it.

In other words, sovereign Palestine will have statehood rights Israel fears. What better way to slap it down, using the power of the law, not retaliation.

International Committee of the Red Cross (ICRC) - The hardship faced by Gaza's 1.5 million people cannot be addressed by providing humanitarian aid. The only sustainable solution is to lift the closure.

The serious incidents that took place on 31 May between Israeli forces and activists on a flotilla heading for Gaza once again put the spotlight on the acute hardship faced by the population in the Gaza Strip.

As the ICRC has stressed repeatedly, the dire situation in Gaza cannot be resolved by providing humanitarian aid. The closure imposed on the Gaza Strip is about to enter its fourth year, choking off any real possibility of economic development. Gazans continue to suffer from unemployment, poverty and warfare, while the quality of Gaza's health care system has reached an all-time low.

The whole of Gaza's civilian population is being punished for acts for which they bear no responsibility. The closure therefore constitutes a collective punishment imposed in clear violation of Israel's obligations under international humanitarian law.

"The closure is having a devastating impact on the 1.5 million people living in Gaza", said Béatrice Mégevand-Roggo, the ICRC's head of operations for the Middle East. "That is why we are urging Israel to put an end to this closure and call upon all those who have an influence on the situation, including Hamas, to do their utmost to help Gaza's civilian population. Israel's right to deal with its legitimate security concerns must be balanced against the Palestinians' right to live normal, dignified lives."

The international community has to do its part to ensure that repeated appeals by States and international organizations to lift the closure are finally heeded.

Under international humanitarian law, Israel must ensure that the basic needs of Gazans, including adequate health care, are met. The Palestinian authorities, for their part, must do everything within their power to provide proper health care, supply electricity and maintain infrastructure for Gaza's people.

Furthermore, all States have an obligation to allow and facilitate rapid and unimpeded passage of all relief consignments, equipment and personnel.

Israeli soldier Gilad Shalit is about to enter his fifth year in captivity. Hamas has continued to rebuff the ICRC's requests to let it visit Gilad Shalit. In violation of international humanitarian law, it has also refused to allow him to get in touch with his family. The ICRC again urges those detaining Gilad Shalit to grant him the regular contact with his family to which he is entitled. It also reiterates that those detaining him have an obligation to ensure that he is well treated and that his living conditions are humane and dignified.

Ruined livelihoods

Although about 80 types of goods are now allowed into Gaza – twice as many as a year ago –over 4,000 items could be brought in prior to the closure. Generally, the price of goods has increased while their quality has dropped – this is one consequence of the largely unregulated trade conducted through the tunnels that have been dug under the Gaza-Egypt border to circumvent the closure.

Fertile farmland located close to the border fence has been turned into a wasteland by ongoing hostilities, affecting people's livelihoods in many rural communities. The buffer zone imposed by Israel extends in practice over one kilometre into the Gaza Strip, covering a total area of about 50 square kilometres that is host to nearly a third of Gaza's farmland and a large share of its livestock. Agricultural activities in the area are hampered by security conditions. Israel's enforcement of the buffer zone and frequent hostilities have resulted not only in civilian casualties and the destruction of civilian property but also in the impoverishment and displacement of numerous families.

Gaza's fishermen have been greatly affected by successive reductions imposed by Israel on the size of the fishing grounds they are allowed to exploit. The latest restriction to three nautical miles has cut down both the quantity and quality of the catch. As a result, nearly 90% of Gaza's 4000 fishermen are now considered either poor (with a monthly income of between 100 and 190 US dollars) or very poor (earning less than 100 dollars a month), up from 50% in 2008. In their struggle to survive, the fishermen have little choice but to sail into no-go zones, at the risk of being shot by the Israeli navy.

"I have already been arrested and my boat has been confiscated several times," said Nezar Ayyash, who heads Gaza's fishermen's union. "But this is our life here. We know that fishing can cost us our lives, but we have no other choice but to go out with our boats: we need to feed our families."

No cure in sight for ailing health-care system

Gaza is suffering from an acute electricity crisis. The power supply in Gaza is interrupted for seven hours a day on average. The consequences for public services, especially the primary health-care system, are devastating. Hospitals rely on generators to cope with the daily blackouts.

The power cuts pose a serious risk to the treatment of patients – and to their very lives. It takes two to three minutes for a generator to begin operating, and during that time electronic devices do not function. As a result, artificial respirators must be reactivated manually, dialysis treatment is disrupted and surgery is suspended as operating theatres are plunged into darkness.

To make matters worse, fuel reserves for hospital generators keep drying up. Three times this year, fuel shortages have forced hospitals to cancel all elective surgery and accept emergency cases only. Gaza's paediatric hospital had to transfer all its patients to another facility because it could no longer function. Laundry services have repeatedly shut down. With the prospect of increased electricity consumption during the hot summer months when air conditioning is required, the situation is likely to deteriorate further if hospitals do not receive ample fuel.

Fluctuations in the power supply can also damage essential medical equipment. Repairs are difficult owing to the closure, under which the transfer into Gaza of spare parts for medical equipment is subject to excessive delays of up to several months.

The transfer of disposable electrodes, which are used to monitor the heart rhythm of cardiac patients, has been delayed since August 2009. Without this equipment, patient lives are at risk, as heart problems may not be detected in time. Because of the restrictions in place, most heart monitors in Gaza will be unusable by the end of this month. The run-down state of equipment is one of the reasons for the high numbers of patients seeking treatment outside the Strip.

Stocks of essential medical supplies have reached an all-time low because of a standstill in cooperation between Palestinian authorities in Ramallah and Gaza. At the end of May 2010, 110 of 470 medicines considered essential, such as chemotherapy and haemophilia drugs, were unavailable in Gaza. When chemotherapy is interrupted, the chances of success drop dramatically, even if another painful round of treatment is initiated. Haemophilia patients face life-threatening haemorrhages when compounds such as Factor VIII and IX are not available.

More than 110 of the 700 disposable items that should be available are also out of stock. The only way to cope is to re-use such items as ventilator tubes or colostomy bags, even though doing so can lead to infections that endanger patients' lives.

"The state of the health-care system in Gaza has never been worse," said Eileen Daly, the ICRC's health coordinator in the territory. "Health is being politicized: that is the main reason the system is failing. Unless something changes, things are only going to get even worse. Thousands of patients could go without treatment and the long-term outlook will be increasingly worrisome."

The health-care system is further weakened by severe restrictions imposed on the movement of people into and out of Gaza. The restrictions prevent medical staff from leaving the Strip to get the training they need to update their skills, and technicians from entering to repair medical equipment.

Lack of sanitation hazardous for health and the environment

The lack of proper sanitation and certain agricultural practices are polluting Gaza's aquifer. Only about 60% of the territory's 1.4 million inhabitants are connected to a sewage collection system. Raw sewage discharged into the river Wadi Gaza, which snakes through urban areas, jeopardizes the health of the communities living on its banks.

Because the aquifer is over-exploited, drinking water in most of Gaza contains high levels of nitrate, chloride and salt. The water is unfit for consumption, and the risk of contracting an infectious disease is high.

Assembling enough suitable materials to carry out sanitation projects is a slow and haphazard process. Materials obtained through the tunnel trade can be of questionable quality, while some items, such as certain electro-mechanical pumps, cannot be found at all, which hobbles construction efforts.

"The current situation is critical and may lead to an irreversible trend in the degradation of underground fresh water," said Javier Cordoba, who oversees the ICRC's water and sanitation activities in Gaza. "Large-scale projects, such as the construction of a desalination plant, must be undertaken to meet water-supply needs without further exposing the aquifer. The closure must be lifted so that the 4.5 billion US dollars pledged by donor countries over a year ago can be put to use."

ICRC activities in 2010

In Gaza, the ICRC continues to work closely with the Palestine Red Crescent Society, supporting its efforts to boost its capacities as a provider of core humanitarian services within the Gaza Strip, which include pre-hospital emergency care and psycho-social activities. The ICRC has also provided support for construction and renovation work carried out on three stations of the Palestine Red Crescent emergency medical services, two of which were damaged during last year's war.

The ICRC closely monitors the situation of civilians adversely affected by the conduct of hostilities or armed violence. It makes confidential representations to the authorities or armed groups concerned, reminding them of their obligation to comply with international humanitarian law and other international rules.

The ICRC endeavours to ensure that a certain level of care is maintained for sick and injured patients, but owing to restrictions there is only so much it can do. It delivers spare parts needed to keep medical equipment in working condition. In addition, to help hospitals cope with the most urgent needs, it regularly supplies medical facilities with drugs and other medical items intended mainly for emergency rooms and operating theatres. It also provides technical assistance and supplies for the Artificial Limb and Polio Centre in Gaza City, where over 1,000 patients have received treatment this year.

The ICRC is doing everything it can to enhance the power and water supply in hospitals, where it is also seeking to improve sanitation, laundry and other services. In addition, it is building an extension to the Polio Centre in Gaza City.

The ICRC continues to work on upgrades for the Rafah wastewater treatment plant which will eventually serve some 170,000 people. However, to finish the work, certain materials must be allowed in through the crossing points. The upgrades, once completed, will result not only in a safer and more healthful environment for the population, but also in treated wastewater clean enough to seep into and refresh the aquifer, which remains the sole source of drinking water in the Gaza Strip.

The ICRC helps needy families in Gaza to make ends meet through cash-for-work programmes, and helps farmers to increase crop yields. In particular, the aid it provides enables farmers to reclaim and develop land degraded by military operations or enforced neglect, to improve soil fertility and productivity, and to obtain enough seedlings for each agricultural season.

Over 800 Gazan detainees in Israeli prisons have been prevented from meeting face-to-face with their loved ones since June 2007, when Israel suspended the ICRC's family visit programme. To mitigate the effects of this measure, the ICRC has doubled its own visits to Gazan detainees and stepped up its efforts to maintain family links by delivering written and oral messages between detainees and their families.

Between January and May 2010, the ICRC:

Popular Committee Against Siege PCAS issues a comprehensives report on the latest of siege outcomes which hit all life aspects. The crisis came up strongly as Israel completely closed crossings, banned food stuff, fuel shipments and all products into Gaza Strip.

The recent Israeli hazardous siege tightened 20 days ago is considered as a death sentence against Human as well as birds and animals. PCAS chairman, MP Jamal EL khoudary expressed his deep anger towards Israeli policy of collective Punishment. He considered what's happening as flagrant violations of all international humanitarian accords particularly the Fourth Genva Convention.

This new report comes out as a final call before a real collapse hits the life totally. This report uncovers part of enormous repercussions resulted in Israeli inhuman siege. It is also a clear message to United Nations, European Union and International Community to take responsibility immediately and end siege.

Siege Report of the latest 20 days only:

Health Sector:

Crisis and Catastrophes:

- A severe shortage of basic medicines is up to 40%. Medicines of diabetes, heart, asthma and other chronic diseases are vanished from Gaza. Additionally, other kind of medicines for Cancer, Lennar and liver failure face sharp shortages.

- Sterilization and Disinfection and medical equipments and clothes face decrease up to 30%.

- There is severe shortage in Solutions and pigments and laboratories tools. These shortages amounted of 40% directly affect patients.

- Some Medical Machines are in bad need for spare parts and maintenance. Due to siege none of the needed is being achieved. Medical machines of Gas measurements of children incubators are being affected as well.

- The power cuts and continued blackouts damaged part of machines and its programming systems.

- Damage hit C.T and X.Ray Departments at al Shifa' and European hospitals. These are so crucial to diagnosis tumours of cancer and other diseases. Spare parts for medical T.V are not available!

- Gases used for surgeries are not enough and what's available is only for 7 days. In the normal time there has to be a strategic storage for at least 3 months of these gases.

- Generators of hospitals are working for long hours due to Power cuts and this affected performance, already a generator of Al shifa' hospital stopped.

- Natural cocking gas is not available leaving kitchens of all gazan hospitals closed. This affects food quality for sick people. Additionally, laundries of clothes and medical cloths are closed vowing of more disease.

- Vaccines for children are about to vanish vowing of problems for children in regard of immunity against diseases.

- Around 260 peoples already died due to closure and not being able to travel. More than 35% of victims are of children.

- Hospitals run the badly needed surgeries and some other normal ones due to the above problems.

- Around 60% of ambulances are being stopped and some medical vans as well.

Agricultural, Animal and Bird Sector:

This sector is one of most negatively affected by recent closure of collective punishment. Animals are and birds are being sorted as terrorists as the same as Gazans in Israeli view.

- Gaza needs 150 tons of fodder a day, since 3 weeks none of it entered.

- More than 700000 of chickens executed due to lack of fodder.

- Looses amounted of 20% due to lack of vaccinations, serums and lack of fodder.

- Fishing sector lacks natural gas needed for fishing and also the process of incubation is being halted.

- Agricultural tools like insecticides, seeds and fertilizer not available. This negatively affects the sector and already did with start of siege.

<img src="http://sabbah.biz/mt/wp-content/uploads/2008/11/gaza2.jpg" alt="Palestinians queue with their cooking gas bottles at a station in the central Gaza Strip refugee camp of al-Nusseirat.
- Agricultural products are being held in Gaza as Israel prevents any kind of exportation since a year and a half.

Closing Commercial Crossings:

Israel closed crossings and decreased quantities of all sorts of commodities into Gaza starting in mid of 2007. Only 15% of Gaza's needs amounted of 600 vans get into Gaza. On the 4th of November, Israel closed all crossings totally. Even the 15% which is not enough, Israel cut it.

Fuel Crisis:

Israel completely cut all kind of fuel including the Industrial one needed for the key power plant. Cocking gas, fuel, Benzine and Gasoline don't enter Gaza leaving people in dire situation.

The power plant is function 50% of its capacity as it was hit by Israel in 2006. It produces around 70 Megawatt out of 140 Megawatt due to lack of spare parts. It consumes around 300 thousands litters of industrial fuel beside the storage fuel, none of that entered Gaza for the last 20 days.

The stoppage of plunged 50-60% into deep darkness due to lack of power. The rest parts depend on Israeli and Egyptian power. Israeli power lines are in bad need for maintenance and repair.

Bread and Bakeries Crisis:

In Gaza the number of bakeries is 47 but now the working ones are 17 only.

Normally, Gaza needs 450 tons of flour; 100 goes for bakeries and 300 for house use. Part of the house share is being provided by UNRWA which halted its work lately.

The remaining flour and wheat quantities would be covering the needs of people for 15 days. After then and if Israel would no be opening border points then a real famine would happen.

Water and Sewage:

The setcor faces a sharp shortage in chlorine needed for Water and soon it will not be pumped along with drinking water. Therefore, contaminated water mixed with sewage would be a reason for plagues.

A more bacterium water would be pumped for civilians in Gaza. Gaza needs 60 cubic of chlorine material and the recent storage is Zero.

Around 100 water wells work out of 145 with 60% capacity of the normal performance. 45 water wells work with ability of 80% this due to spare parts shortage and Israeli closure.

Consumption of water is 220 thousand cubic in the normal time. However, it decreased to 40%. Some areas in the Gaza strip don't get water especially the high locations.

Another serious outcome is sewage water leaking into the sea. It is estimated of 77million litters a day This kills fish resources and causes environmental disaster.

Commodities and Food Crisis:

Basic food stuff like milk, flour, food oils, meat, rice and legumes are not available with big quantities. Other needs are not available like raw materials.

Estimates for daily consumption of the following food products in the Gaza Strip are: 867 tons of flour, 153 tons of sugar, 110 tons of rice, 75 tons of different kinds of oil and 49 tons herbs and vegetables. According to crossing administration only 15 % of Gaza needs get in.

UNRWA Crisis:

Due to the crossing closures all kind of services and relief stuff are being banned to get into Gaza. The UNRWA which provides food parcels for 750.000 persons stopped its vital work.

Industrial Sector:

The industrial sector depends completely on imported raw materials. It depends up to 80% on imported machines and spare parts, and during the peak season of production (May - June) it is possible to export 748 truckloads of industrial products per month (including furniture, food products, clothing and agricultural products).

Since the beginning of the siege, the Occupation cancelled the application of its Customs Code for the Strip, resulting in the stopping of all industrial activities, which depends up to 85% on imported raw materials that are imported from Israel or in transit through it, and statistics indicate that more than 97% of industrial establishments, a total of 3,900, were shut down, stopping the export of their product; as a consequence 33,000 out of 35,000 employees and workers in this sector joined the ranks of the unemployed up to the date of the imposition of the siege in mid June 2007, and after the siege the number of employed industrial workers does not exceed 1,500.

The Israeli government forbade the entrance of paper for making text books to children from Gaza Strip, denounced Palestinian-Israeli Information-Investigation Center (CIIPI).

A released issued by the institution revealed that Palestinian children will attend the classrooms in September without their pens, pencils, books and more if the military command withholds the entry of five supply trucks to the region.

The Israeli Defense Ministry is considering if the load is part of the humanitarian aid material that should enter Gaza Strip, blockaded since June 14 when it was taken by the Islamic Resistance Movement.

The schools of the region are funded by the UN Agency of Palestinian Refugees, revealed the note.

CIIPI has always defended education as a way to achieve peace between Israeli and Palestinians but maintains that there cannot be education without supplies, stated the release.
